Ski Resort Challenge 2008-2009

General rules

Information on how to enter and the prize form part of these General rules. Participation in this promotion is deemed acceptance of these General rules.
No purchase is required to enter the contest.
During the promotional period, visitors of the website MountVacation.com who enter a vote in the Ski Resort Challenge of that current week enter the contest. Visitors can vote only once in each of the challenges but can vote in every challenge. For seven (7) consecutive weeks, different challenges will be posted on the website. A prize is to be won at the end of each challenge, and a grand prize at the end of the promotional period. Each vote entered during each individual challenges will constitute one entry to win the grand prize at the end of the contest.
The prize to be won by a visitor at the end of each challenge (week) will be announced on the MountVacation.com website. The prize to be won by a visitor at the end of the contest is a 7-day ski vacation in Résidence Dame Blanche in Puy Saint Vincent, France, from the 21.03.2009 to the 28.03.2009, including an apartment for 4 persons and 7-day ski passes.
Visitors must enter a valid email address to validate their vote.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these General rules or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or illegible entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the email account is held.
Promotion commences 19^th of December 2008. Entries close at 11:59am CET on 6/02/2009. For every challenge, the promotion commences at 12:00pm (noon) on Friday and ends at 11:59am the following Friday. The weekly draw will take place at OBS d.o.o., 63 Vojkova, Ljubljana, 1000 Slovenia, the Monday following the end of a challenge, at 2pm. The grand prize at the end of the contest will be drawn on 7/02/2009, at 2pm. Winner will be immediately notified by email and the winner's name will be published in the following MountVacation.com Newsletter and on the MountVacation.com website.
The first valid entry drawn will win the weekly prize, as indicated on the MountVacation.com website.
MountVacation.com is responsible for all shipping costs of the prize to the winner’s residence.
The compliance to all tax and customs regulations of the winner’s country of residence is the winner’s responsibility.
The Promoter's decision is final and no correspondence will be entered into.
If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
The winner has 7 days from the day the notice was sent to claim his prize. If for any reason a winner does not claim the prize by that time, then the prize will be forfeited.
If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Prizes are not transferable or exchangeable.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any theft, unauthorized access or third party interference; (b) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (c) any variation in prize value to that stated in these Terms and Conditions; (d) any tax liability incurred by a winner or entrant; or (e) any delays, disturbances, terrorist acts, omissions, accidents, or vendor and property quality or supplier changes (whether or not under the Promoter's control).
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to the European Union regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
