Please read these General Terms and Conditions carefully. These General Terms and Conditions describe our contractual obligations to you, and your contractual obligations to MountVacation.com. It answers all questions that may appear about deposits and cancellation penalties. By clicking the NEXT button at the end of this page, you will be bound by these terms and conditions.

The website MountVacation.com and OBS d.o.o. (MountVacation.com) offers its services exclusively on the basis of these General Terms and Conditions. The General Terms and Conditions provisions govern the legal relationship between you as customer and MountVacation.com and constitute a part of the contract between you and MountVacation.com. MountVacation.com regularly operates solely as an internet broker and not a broker of distinct accommodation services. MountVacation.com will operate solely as an intermediary between you and respective service providers, such as hotel operations, and acts on behalf and to the account of both, you and the respective service provider. Insofar as MountVacation.com offers internet links to third-party offers in the course of individual transactions, MountVacation.com does not operate as an intermediary of those third-party services. Please be advised that price, conveyance, and general travel conditions of the relevant individual service provider(s) will apply to the contents of the agreement between you and the service provider(s). These conditions may govern the conditions of payment, deadlines, liability, cancellation, booking alterations, reimbursement as well as other details of the hotel agreement for clarification purposes only.

The information on this website is the sole responsibility of the MountVacation.com. It is not issued on behalf of either: the ski resorts, the hotel chains, individual hoteliers, or suppliers of self-catering accommodations, and neither accepts responsibility for it.

The on-line prices are calculated as accurately as possible according to the information input by you, the client, and information input by individual hotels. However, because of the complex nature of calculations and numerous different combinations of hotel rooms, we cannot guarantee the online prices. All rooms and prices on the website are subject to availability.

You may only use the website to make legitimate enquiries or bookings. You are not permitted to make any speculative, false or fraudulent bookings, or any booking in anticipation of demand. If we are reasonably of the opinion that such a booking has been made we shall have full right to cancel the booking and inform the relevant authorities of the respective countries.

You also undertake to provide correct and accurate email, postal and/or other contact information to us and give us right to use these details to contact you in case that it should prove to be necessary (see our «Privacy Policy»). If you do not give us all of the information that we need, we may not be able to complete your booking. You shall be liable to us for any damage sustained due to any speculative, false or fraudulent bookings and/or contact information made or given by you.

The MountVacation.com website has been compiled with the greatest possible care. Our services are based on the information provided by the hotels; for this reason, the hotels remain responsible for the correctness of this information. Hotels can alter the information about their hotel, such as prices and availability, at any moment. We can therefore not guarantee that all the information is accurate and faultless, nor can we be held responsible for errors or inaccuracies in the supplied information. You should always check the provided information before acting on the basis of the supplied information.

This website is intended only as an invitation and it does not constitute an offer by MountVacation.com. Any booking made by you shall be deemed to be a binding offer by you which we may, at our choice, accept. No contract shall exist until payment is received and the booking is confirmed to you as applicable under these GTC.

The offer is established through the completion of the booking sequence whereby you click on the appropriate button(s). You are bound to this offer for a maximum of 48 hours. If neither MountVacation.com nor respective hotel services provider confirms the booking via electronic media within 48 hours following the entry of the offer, you are no longer bound by your offer. A booking confirmation will serve as an acceptance. A booking confirmation will generally be sent immediately to your email address following the completion of the booking sequence together with the booking-code and at it will be at the same time sent to the respective hotel service provider of your choice.

Once we have received your booking request and have responded with a confirmed price and availability for your accommodation we can guarantee that this price and booking is accurate and will be held for 48 hours from the time of our return email to you. Hotel services provider holds the right to cancel the booking within said 48 hours from the time of our return mail to you, if booked accommodation term was available only due to mistaken check in, in case of late check out of unavailable terms and in case of unauthorised system abuse by third party.

MountVacation.com shall forward all your reservation information, excluding the credit card details, to the hotel service provider via a secure connection.

MountVacation.com shall charge you directly via credit card secure payment, PayPal or Money Bookers, or via bank transfer, in the amount of 10% of the total accommodation price as respectively booked. The 90% of the accommodation price will be paid by you at the respective hotel services provider upon arrival or departure, as applicable by individual provider.

In some cases (indicated with the booking path), we ask for full prepayment before your departure. We will send you an invoice for the remaining 90% of your purchase directly to your email box and ask you for the final payment. If your arrival is less of 90 days from the booking date, you will be given the option to either pay 100% of the purchase price at the time of booking or 10% at the time of booking and the outstanding balance 56 days prior to arrival. If you pay by credit or debit card, we shall automatically process the payment at the time of booking in accordance with the above terms. You hereby give us your consent for this procedure. Failure of payment due to unauthorized or improper use of the credit card or any other reason shall result in your booking being cancelled.

As the purchase is being completed, you are bound by these terms and conditions. The relevant invoice will be sent the working day following the day of your booking. Please note that it is your responsibility to check carefully the details of your booking as soon as you receive them, and to notify us of any irregularities.

For security of payment, credit card details are taken and shall be kept by MountVacation.com until you have covered the full accommodation price, as a guarantee of reservation only and shall be deleted after hotel service provider was fully compensated.

Note that whenever you provide us with personal details or credit card information, such as your credit card number, name, address, and telephone number, they are protected by powerful Secure Sockets Layer (SSL) encryption technology as it travels through the internet.

You must present your booking confirmation details to the accommodation services provider upon arrival as they are proof of pre-payment.

It is your responsibility to check the confirmation and ensure that all of the details are correct. Accommodation will only be provided in accordance with the details listed in the confirmation. If the details on the confirmation are not correct, you should contact us prior to travel at info@mountvacation.com.

It is also your responsibility to ensure the accuracy of the information you input into the on-line form before you complete the booking. If you make a mistake, we will try to correct the booking details but provide no guarantee that this will be possible. The cost of the service requested may vary on amendment of the details and if so you will have to pay these in addition. A new confirmation email will be sent to you. If the new details do not suit you, you may cancel your booking in accordance with Article 9 of these General Terms and Condition.

MountVacation.com assumes no liability for the performance of the hotel and accommodation services and provides no guaranty with regard to the quality or fitness of the services as represented nor does MountVacation.com, which operates solely as an intermediary, supply any guaranty for the availability of hotel and accommodation services.

Unexpected events can lead to unavoidable cancellation of holidays which can involve you in substantial cancellation charges. Illness or personal loss abroad can be costly at best. That is why you are obligated to purchase a cancelation insurance policy to an extra cost of 2,5% per total sum of your reservation. This cancelation insurance is for your and MountVacation.com's safety, to arrange for your holiday insurance, as your holiday may be obstructed due to reasons that are beyond our or your control (sickness, death in your family or any other occasion mentioned in a terms and conditions of our partner Mondial Assistance International AG).

From time to time you may find a link to a partner of ours in order to get information for medical & assistance travel insurance policies. However, it is at your absolute discretion to choose your insurance provider.

We do not insist that you take out personal travel cover with us, although we believe our premiums are competitive. If you do not take out insurance with us, it is a condition of booking that you indemnify MountVacation.com against all costs, losses and liabilities that would have been covered by such insurance.

You are also liable to respect all customs and monetary regulation of your country and the country of your destination. If you shall at any point be banned to continue the journey or usage of accommodation facilities due to infringement of any of such regulation, you shall be solely liable for all the consequences and costs that such might incur at any such event.

The client is entitled to total reimbursement, minus the cost of travel cancellation insurance premium and 50 € administrative costs, caused to MountVacation.com by the processing of booking. Reimbursement is paid directly to the clients' account. If one claims in, it is neccessary to write the following data: account number and bank.
